Privacy Notice – AST Thailand
At Aetna Services (Thailand) Limited (“AST”) we are committed to protecting and respecting your privacy.
This privacy notice describes how personally identifiable information and personal health information (“PHI”) (collectively referred to as “Personal Data”) about you (the “Data Subject”) may be collected, used and disclosed, and how you can get access to this information. Please review it carefully.
The entity which controls your Personal Data is AST which has its registered office at98 Sathorn Square Office Tower, 14th - 15th Floor, North Sathorn Road, Silom, Bangrak, Bangkok 10500, Thailand.
1. Introduction
In order to provide you with primary medical services through the use of verbal telephone calls or video consultation via the VHealth Mobile Application (the “vHealth Services”), you may be required to provide us with your Personal Data to ensure your maximum benefit from the vHealth Services. Therefore, AST will have to collect, use and disclose your Personal Data, where you have provided fully informed and explicit consent, in accordance with the applicable laws of Thailand, to provide you with the vHealth Services.
We will never use or share your Personal Data for any purpose other than as defined in this privacy notice and strictly for the purpose of rendering the vHealth Services for the benefit of the person identified by the Personal Data collected.
2. Scope
vHealth Services is operated globally and is committed to full compliance with all applicable laws and regulations of any jurisdiction.
3. Fundamental Principles
AST's privacy practices comply with the applicable laws of Thailand which govern the collection, use, processing and disclosure of your Personal Data which may be in force from time to time. We will process your Personal Data in accordance with the following principles and protections:
- Your Personal Data will be processed lawfully, transparently and fairly
- Limiting Personal Data use to an appropriate purpose as allowed by you
- Limiting the processing and storage of your Personal Data to the minimum necessary
- Making sure this privacy notice is accurate and sufficient
- Maintaining open and transparent privacy policies
- Being accountable to you for processing your Personal Data
- Making sure your consent is obtained and easy to withdraw
- Defining and protecting your Personal Data, and other particularly sensitive information
- Ensuring our service providers apply similar or equivalent standards of privacy controls where they process your Personal Data on our behalf
- Not transferring your Personal Data outside of Thailand other than in accordance with applicable legal requirements and principles and as provided herein.
- Giving you the right to concise, timely, comprehensive information regarding our processing of your Personal Data
- Giving you the right to rectify incomplete, inaccurate, unnecessary or excessive Personal Data.
- Giving you the right to object to the collection, use processing and/ or disclosure of your Personal Data (as may be permitted by the applicable laws of Thailand).
- Making sure we have procedures to support your exercising of any Data Subject rights.
- Applying security measures, including technical and procedural support for integrity, confidentiality and availability.
- Maintaining the confidentiality of your Personal Data even after our relationship with you has terminated.
4. International Transfers
In order to better protect your data, AST uses data centres based in Singapore and Hong Kong SAR that comply with all the privacy, security and contingency measures and regulations.
With your acceptance, you are also entering into an agreement for such matters with Aetna Global Holdings Limited (England & Wales) and Aetna Global Benefits (Bermuda) Limited (Bermuda), subsidiaries of Aetna International Inc. in the USA who own the agreements with servers in the Singapore and Hong Kong SAR. By accepting this privacy notice, you are agreeing to the international transfer of your Personal Data as stated above.
You should check whether it is lawful to access our vHealth Services in the territory where you are, if you are outside of Thailand.
5. Contact Information
You may request information, file a complaint, withdraw your consent and exercise your rights of access, rectification, suppression, limitation of treatment, portability and opposition to processing by emailing the Data Protection Officer at dpo@aetna.com, indicating your name, what service was used and your telephone number, and attaching your identification card or any other document that permits us to identify you.
If you have a question, would like a copy of this privacy notice or you believe your privacy rights have been violated, you may contact the Data Protection Officer at the above email address. There will be no retaliation for filing any complaint or exercising any subject rights.
6. What Personal Data is Collected
- Personal Data is information or data that directly identifies you or when used in combination with information available publicly or in the possession of AST, and which may provide a high probability of identifying you.
- Personal Data also includes PHI about the individual identified by the data.
7. How Personal Data is used, processed and disclosed
- AST collects, processes and discloses your Personal Data for the purposes of providing you with the vHealth Services.
- AST may disclose your Personal Data to our of its affiliates, directors, employees, physicians, case managers and medical experts or any other agents or representatives of AST, or if necessary, service providers on a need-to-know basis for the purpose of providing the vHealth Services to you.
- AST does not share your Personal Data for any purpose not both: (a) defined in this privacy notice or in your consent; and (b) required for providing the vHealth Services.
- AST also may use your Personal Data to review or evaluate the performance of our systems in providing the vHealth Services to you, and to improve the quality or timeliness of our vHealth Services. AST also may create anonymised information which does not include your name, address, birth date, or other information that could be used to identify you. This anonymised information may be used for quality improvement, research and other purposes. For example, AST may use this anonymised information to demonstrate the reliability of our information management systems or to generate medical research information.
- We do not use third-party cookies or non-AST web beacons i.e. web based data collection by other than AST such as advertising or tracking links.
- Other disclosures mandated by applicable laws: AST may be called upon to disclose your Personal Data by a duly empowered branch of Government or Court in any country in which our patients are a citizen.
- To the extent permitted by applicable laws of Thailand, we may collect, use and disclose your Personal Data without your consent, if:
(1) it is for achieving the purpose relating to preparation of historical documents or archives for public interest or relating to research or statistics, where the suitable preventive measures are provided;
(2) it is for preventing or suppressing a danger to a person’s life, body or health;
(3) it is necessary for the performance of a contract, which you are a party, or the compliance with your request prior to entering into a contract;
(4) it is necessary for the performance of a task carried out in the public interest by AST, or for the exercising of governmental authority authorized to AST;
(5) it is necessary for legitimate interests of AST or any other persons or juristic persons, except that such interests are less important than your fundamental rights in your Personal Data; and
(6) it is necessary for compliance with laws.
8. Data Retention
- AST will retain your Personal Data for as long as it is needed for providing the vHealth Services to you but for not more than 10 years.
- When you are no longer eligible for the vHealth Services, your Personal Data is securely destroyed or permanently de-identified in accordance with the applicable laws of Thailand. Any and all codes, links, or other data that could be used to relate the de-identified data to you are permanently destroyed.
- Such permanently de-identified data is no longer Personal Data and is retained by AST indefinitely. Note that it is not possible to identify you from this de-identified data, and therefore data subject rights would not be applicable to this data.
- We insist that any service providers who we retain to provide support services to AST, adhere to our Privacy Policy and Principles as well as all globally applicable data privacy laws.
9. Security Enforcement
- We safeguard your Personal Data with tested and certified technical and organisational security controls. We educate our staff on our Privacy Policy and Principles, as well as their roles and responsibilities in complying with them.
10. Global Compliance
- We are committed to complying with applicable data privacy laws in all regions where we have subsidiaries and affiliates.
11. Your Personal Data Rights
Apart from the abovementioned and to the extent permitted by the applicable laws of Thailand, you have the following rights in relation to your Personal Data:
- You have the right to withdraw your consent to the collection, use, processing and disclosure of your Personal Data at any time.
- We strive to keep your Personal Data accurate and current and we will update or disclose it to you whenever you request us to do so. You are responsible for communicating modifications, rectifications or additions to your Personal Data in order that AST may change it accordingly and keep it current.
- You are able to access and obtain a copy of your Personal Data.
- You can request us to disclose the details of a possession of your Personal Data obtained without your consent.
- You can correct or update your Personal Data or request us to do so if it is inaccurate or outdated.
- You have the right to receive your Personal Data from us. Additionally, in case we arrange your Personal Data in the format which is readable or commonly used by ways of automatic tools or equipment and can be used or disclosed by automated means, you are also entitled to: (1) request us to send or transfer your Personal Data in such formats to other data controllers if it can be proceeded by the automatic means; and (2) request to directly obtain your Personal Data in such formats that we send or transfer to other data controllers, unless it is technically impossible.
- You have the right to request us to restrict the use of your Personal Data or erase or destroy your Personal Data or anonymize your Personal Data which cannot identify you.
- You have the right to file a complaint in the event that we, our employees or our service providers violate or do not comply with the applicable laws of Thailand.
12. Access to our services
Access to AST sites are controlled and restricted to registered patients, and our own staff of physicians, case managers and medical experts. AST has implemented manual and technical, physical and electronic security controls to best ensure that our systems and data are secure. These controls are continuously monitored and upgraded as required by changing business processes, new data security threthreats and as better security controls become available.

คำประกาศการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ เป็นการแจ้งให้ทราบถึงรายละเอียดในการเก็บ ใช้ และเปิดเผยซึ่งข้อมูลที่ระบุตัวบุคคลได้ และข้อมูลสุขภาพส่วนบุคคล (“ข้อมูล PHI”) (ซึ่งจะเรียกรวมกันว่า “ข้อมูลส่วนบุคคล”) ที่เกี่ยวกับท่าน (“เจ้าของข้อมูล”) รวมถึงวิธีการและเงื่อนไขที่ท่านอาจเข้าถึงหรือขอรับข้อมูลดังกล่าวได้ ดังนั้น จึงขอให้ท่านอ่านทำความเข้าใจประกาศฉบับนี้โดยละเอียดถี่ถ้วน
นิติบุคคลที่เป็นผู้ควบคุมข้อมูลส่วนบุคคลของท่าน ได้แก่ AST ซึ่งมีสำนักงานจดทะเบียนตั้งอยู่เลขที่ 98 อาคารสาทร สแควร์ ออฟฟิศ ทาวเวอร์ ชั้น 14–15 ถนนสาทรเหนือ แขวงสีลม เขตบางรัก กรุงเทพฯ 10500 ประเทศไทย
1. ความนำ
ในการให้บริการเบื้องต้นด้านการแพทย์แก่ท่าน ด้วยการให้คำปรึกษาทางโทรศัพท์ หรือทางวีดิโอคอล ผ่านแอพพลิเคชั่นมือถือ vHealth (ซึ่งจะเรียกรวมกันว่า “บริการ vHealth”) นั้น เราอาจจำเป็นต้องขอให้ท่านให้ข้อมูลส่วนบุคคลแก่เรา เพื่อที่ท่านจะได้รับประโยชน์สูงสุดจากบริการ vHealth ด้วยเหตุนี้ ในอันที่จะให้บริการ vHealth แก่ท่าน AST จึงจะต้องเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่าน โดยจะทำการแจ้งวัตถุประสงค์ให้ท่านทราบ พร้อมขอความยินยอมโดยชัดแจ้งจากท่านตามกฎหมายไทยที่เกี่ยวข้องก่อน
เราจะไม่ใช้หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน เพื่อวัตถุประสงค์อื่นใดนอกเหนือจากวัตถุประสงค์ที่แจ้งไว้ในคำประกาศฉบับนี้ และนอกเหนือจากวัตถุประสงค์ของการให้บริการ vHealth เพื่อประโยชน์แก่บุคคลที่เป็นเจ้าของข้อมูลส่วนบุคคลที่เราได้เก็บรวบรวมไว้
2. ขอบเขตการดำเนินการ
บริการ vHealth เป็นระบบบริการที่มีการดำเนินงานทั่วโลก และยึดมั่นในการปฏิบัติตามกฎหมายและข้อบังคับที่เกี่ยวข้องอย่างครบถ้วนในทุกประเทศ
3. หลักการสำคัญ
หลักปฏิบัติด้านข้อมูลส่วนบุคคลของ AST นั้น เป็นไปตามกฎหมายไทยที่เกี่ยวข้องกับการเก็บ ใช้ ประมวลผล และเปิดเผยข้อมูลส่วนบุคคลของท่าน ซึ่งมีผลบังคับในเวลาใดเวลาหนึ่ง โดยเราจะประมวลผลข้อมูลส่วนบุคคลของท่านตามหลักการและมาตรฐานการคุ้มครองข้อมูลดังต่อไปนี้
- ข้อมูลส่วนบุคคลของท่านจะได้รับการประมวลผลโดยชอบด้วยกฎหมาย โปร่งใส และเป็นธรรม
- การใช้ข้อมูลส่วนบุคคลจะอยู่ภายในขอบเขตวัตถุประสงค์ที่ท่านได้ให้ความยินยอมไว้เท่านั้น
- การประมวลผลและเก็บรักษาข้อมูลส่วนบุคคลของท่านจะทำเท่าที่จำเป็นเท่านั้น
- มีการดำเนินการให้แน่ใจว่าคำประกาศการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้มีความถูกต้องและเพียงพอ
- มีนโยบายคุ้มครองข้อมูลส่วนบุคคลที่เปิดเผยและโปร่งใส
- มีความพร้อมรับผิดชอบต่อท่านในการประมวลผลข้อมูลส่วนบุคคลของท่าน
- มีการดำเนินการให้แน่ใจว่าได้รับความยินยอมจากท่านแล้ว และท่านสามารถยกเลิกความยินยอมได้โดยง่าย
- มีการจำกัดความและคุ้มครองข้อมูลส่วนบุคคลของท่าน รวมถึงข้อมูลอื่นที่เป็นความลับหรือละเอียดอ่อน
- มีการดำเนินการให้มั่นใจว่า ผู้ให้บริการของเรามีมาตรฐานเดียวกันหรือเทียบเท่าในการควบคุมดูแลข้อมูลส่วนบุคคล ในกรณีที่ผู้ให้บริการเป็นผู้ประมวลผลข้อมูลส่วนบุคคลของท่านแทนหรือในนามของเรา
- ไม่มีการโอนข้อมูลส่วนบุคคลของท่านออกนอกประเทศไทยนอกเหนือไปจากที่กฎหมายและหลักการที่เกี่ยวข้องกำหนด หรือที่กำหนดไว้ในคำประกาศฉบับนี้
- ท่านมีสิทธิในการเข้าถึงข้อมูลสรุปอย่างทันกาลและครอบคลุมเกี่ยวกับการประมวลผลข้อมูลส่วนบุคคลที่เกี่ยวกับตน
- ท่านมีสิทธิในการปรับปรุงแก้ไขข้อมูลส่วนบุคคลที่ไม่ครบถ้วน ไม่ถูกต้อง ไม่จำเป็น หรือมากเกินความจำเป็น
- ท่านมีสิทธิในการคัดค้านการเก็บ ใช้ ประมวลผล และ/หรือเปิดเผยข้อมูลส่วนบุคคลที่เกี่ยวกับตน (ตามที่กฎหมายไทยที่เกี่ยวข้องกำหนดไว้)
- เราจะจัดให้มีขั้นตอนหรือกระบวนการเพื่อสนับสนุนท่านในการใช้สิทธิของเจ้าของข้อมูล
- มีการดำเนินมาตรการรักษาความมั่นคงปลอดภัยของข้อมูล อันรวมถึงมาตรการทางเทคนิคและทางกระบวนการเพื่อส่งเสริมความครบถ้วนสมบูรณ์ การรักษาความลับ และสภาพพร้อมใช้งานของข้อมูล
- เราจะรักษาข้อมูลส่วนบุคคลของท่านไว้เป็นความลับแม้ภายหลังจากที่การติดต่อเกี่ยวข้องระหว่างเรากับท่านจะสิ้นสุดลงแล้วก็ตาม
4. การโอนข้อมูลไปยังต่างประเทศ
ในอันที่จะคุ้มครองข้อมูลของท่านให้ปลอดภัยยิ่งขึ้น AST ได้เลือกใช้ศูนย์ข้อมูลที่ตั้งอยู่ในประเทศสิงคโปร์ และเขตบริหารพิเศษฮ่องกง ซึ่งดำเนินงานตามมาตรการและกฎระเบียบเกี่ยวกับการคุ้มครอง การรักษาความปลอดภัย และการรองรับภาวะฉุกเฉินด้านข้อมูลอย่างครบถ้วน
นอกจากนี้ หากท่านยอมรับคำประกาศฉบับนี้ ถือว่าท่านยังได้เข้าทำสัญญาในเรื่องดังกล่าวกับ บริษัท เอ็ทน่า โกลบอล โฮลดิ้งส์ (อิงแลนด์แอนด์เวลส์) จำกัด และบริษัท เอ็ทน่า โกลบอล เบเนฟิทส์ (เบอร์มิวดา) จำกัด อันเป็นบริษัทในเครือ เอ็ทน่า อินเตอร์เนชั่นแนล อิงค์ในสหรัฐอเมริกา ซึ่งเป็นคู่สัญญากับผู้ให้บริการเซิร์ฟเวอร์ในสิงคโปร์และฮ่องกงอีกด้วย ท่านตกลงว่าในการตอบรับคำประกาศการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ ท่านยอมรับเงื่อนไขการโอนข้อมูลส่วนบุคคลที่เกี่ยวกับตนไปยังต่างประเทศตามที่ระบุข้างต้น
ในกรณีที่ท่านอยู่นอกประเทศไทย เราขอแนะนำให้ท่านตรวจสอบด้วยว่า การเข้าใช้บริการ vHealth ในประเทศที่ท่านพำนักอยู่นั้นไม่เป็นการผิดกฎหมายท้องถิ่น
5. ข้อมูลติดต่อ
ท่านมีสิทธิที่จะขอข้อมูล ยื่นคำร้องเรียน ยกเลิกความยินยอม และใช้สิทธิของท่านในการเข้าถึง หรือแก้ไขข้อมูล หรือในการระงับ หรือจำกัดการใช้ข้อมูล หรือในการส่ง/โอนข้อมูล หรือคัดค้านการประมวลผลข้อมูลส่วนบุคคลที่เกี่ยวกับตน ด้วยการแจ้งมายังเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคล (Data Protection Officer) ของเราทางอีเมล dpo@aetna.com โดยระบุชื่อและหมายเลขโทรศัพท์ของท่าน บริการที่ท่านใช้ พร้อมแนบ (สำเนา) บัตรประจำตัวหรือเอกสารอื่นใดที่ช่วยให้เราระบุตัวตนของท่านได้
หากท่านต้องการสอบถามข้อมูลเพิ่มเติม หรือต้องการสำเนาของคำประกาศฉบับนี้ หรือหากท่านเชื่อว่าสิทธิข้อมูลส่วนบุคคลของตนถูกละเมิด ท่านอาจติดต่อเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคล ทางที่อยู่อีเมลข้างต้น เราจะปกป้องไม่ได้ท่านได้รับความเดือดร้อนหรือผลกระทบใด ๆ จากการร้องเรียน หรือจากการใช้สิทธิในฐานะเจ้าของข้อมูล
6. ประเภทข้อมูลส่วนบุคคลที่เก็บรวบรวม
- ข้อมูลส่วนบุคคล ได้แก่ ข้อมูลที่สามารถระบุตัวตนท่านได้ไม่ว่าโดยตรง หรือเมื่อใช้ร่วมกับข้อมูลที่เปิดเผยต่อสาธารณะ หรือกับข้อมูลในความครอบครองของ AST และเป็นข้อมูลที่อาจจะช่วยให้ระบุตัวตนท่านได้ง่าย
- ข้อมูลส่วนบุคคล ยังหมายรวมถึง ข้อมูล PHI เกี่ยวกับบุคคลที่เป็นเจ้าของข้อมูลนั้น ๆ
7. วิธีการใช้ ประมวลผล และเปิดเผยข้อมูลส่วนบุคคล
- AST เก็บ ใช้/ประมวลผล และเปิดเผยข้อมูลส่วนบุคคลของท่าน เพื่อประโยชน์ในการให้บริการ vHealth แก่ท่าน
- AST อาจเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่กิจการในเครือ/สาขา กรรมการ พนักงาน แพทย์ พยาบาล/ผู้ดูแลรายกรณี ผู้เชี่ยวชาญทางการแพทย์ หรือตัวแทนอื่นใดของ AST หรือในกรณีจำเป็น ผู้ให้บริการ บนพื้นฐานที่บุคคลดังกล่าวจำเป็นต้องทราบเท่านั้น ทั้งนี้เพื่อประโยชน์ในการให้บริการ vHealth แก่ท่าน
- AST ไม่มีการเปิดเผยข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์อื่นใดนอกเหนือจาก: (ก) ที่ระบุในคำประกาศฉบับนี้ หรือที่ได้รับความยินยอมจากท่าน และ (ข) ที่จำเป็นต่อการให้บริการ vHealth
- AST อาจนำข้อมูลส่วนบุคคลของท่านไปใช้เพื่อทบทวน หรือประเมินผลการดำเนินระบบของเราในการให้บริการ vHealth แก่ท่าน รวมทั้งเพื่อปรับปรุงคุณภาพและความรวดเร็วทันกาลของบริการ vHealth ของเราก็ได้ นอกจากนี้ AST ยังอาจสร้างข้อมูลนิรนามขึ้นที่ไม่ระบุชื่อ ที่อยู่ วันเกิดท่าน หรือข้อมูลอื่นที่อาจใช้ระบุตัวตนท่านได้ โดยอาจใช้ข้อมูลนิรนามดังกล่าวเพื่อการปรับปรุงคุณภาพ การวิจัย หรือเพื่อวัตถุประสงค์อื่น ๆ ตัวอย่างเช่น AST อาจใช้ข้อมูลนิรนามนี้เพื่อแสดงให้เห็นถึงความน่าเชื่อถือของระบบจัดการข้อมูลของเรา หรือเพื่อจัดทำข้อมูลวิจัยทางการแพทย์ เป็นต้น
- เราไม่มีการใช้คุกกี้ของบุคคลที่สาม หรือเว็บบีคอนที่ไม่ใช่ของ AST กล่าวคือ จะไม่มีการเก็บข้อมูลผ่านเว็บโดยบุคคลอื่น เช่น ลิงค์โฆษณา หรือลิงค์ที่เชื่อมโยงไปหาหน้าเว็บอื่น ๆ
- การเปิดเผยข้อมูลในลักษณะอื่นตามบังคับกฎหมายที่เกี่ยวข้อง: หน่วยงานของรัฐหรือศาลผู้มีอำนาจในประเทศเจ้าของสัญชาติคนไข้ (สมาชิก?) ของเราอาจมีคำสั่งให้ AST เปิดเผยข้อมูลส่วนบุคคลของท่านก็ได้
- เราอาจเก็บ ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านเท่าที่กฎหมายที่เกี่ยวข้องกำหนด โดยไม่ต้องขอความยินยอมจากท่านได้ในกรณีดังต่อไปนี้
- เป็นการบรรลุวัตถุประสงค์ที่เกี่ยวข้องกับการจัดทำเอกสารประวัติศาสตร์ หรือจดหมายเหตุเพื่อประโยชน์สาธารณะ หรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติ ซึ่งได้จัดให้มีมาตรการที่เหมาะสมในการปกป้องเจ้าของข้อมูลส่วนบุคคล
- เป็นการป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล
- เป็นความจำเป็นต่อการปฏิบัติตามสัญญาที่ท่านเป็นคู่สัญญา หรือต่อการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญานั้น
- เป็นความจำเป็นต่อการปฏิบัติภารกิจเพื่อประโยชน์สาธารณะของ AST หรือต่อการปฏิบัติหน้าที่ที่ AST ได้รับมอบอำนาจจากหน่วยงานรัฐ
- เป็นความจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของ AST หรือของบุคคล หรือนิติบุคคลอื่นใด เว้นแต่ประโยชน์ดังกล่าวมีความสำคัญน้อยกว่าสิทธิขั้นพื้นฐานในข้อมูลส่วนบุคคลของท่าน

8. การเก็บรักษาข้อมูล
- AST จะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เป็นระยะเวลาเท่าที่จำเป็นต่อการให้บริการ vHealth แก่ท่าน แต่ไม่เกิน 10 ปี
- เมื่อสิทธิของท่านในการรับบริการ vHealth หมดอายุลงแล้ว เราจะดำเนินการทำลายข้อมูลส่วนบุคคลของท่านอย่างปลอดภัย หรือทำให้ข้อมูลไม่สามารถระบุตัวตนได้อย่างถาวร ตามข้อกำหนดกฎหมายไทยที่เกี่ยวข้อง โดยจะตรวจสอบให้แน่ใจว่า รหัส ลิงค์ หรือข้อมูลใด ๆ ก็ตามที่อาจใช้เชื่อมโยงกับข้อมูลที่ถูกทำให้ไม่สามารถระบุตัวตนได้นั้นถูกทำลายโดยถาวรทั้งหมด
- ข้อมูลที่ถูกทำให้ไม่สามารถระบุตัวตนได้โดยถาวรเช่นนี้ถือว่าไม่ใช่ข้อมูลส่วนบุคคลอีกต่อไป และ AST จะเก็บรักษาไว้อย่างไม่มีกำหนด โปรดทราบว่าเนื่องจากข้อมูลดังกล่าวใช้ระบุตัวตนท่านไม่ได้แล้ว ดังนั้นสิทธิของเจ้าของข้อมูลจึงไม่มีผลแก่ข้อมูลประเภทนี้แต่อย่างใด
- เราขอยืนยันว่า ผู้ให้บริการทุกรายที่อยู่ในระบบการให้บริการของ AST มีการยึดปฏิบัติตามนโยบายและหลักการคุ้มครองข้อมูลส่วนบุคคลของเรา รวมถึงกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้องในประเทศต่าง ๆ ทั่วโลก
9. การรักษาความมั่นคงปลอดภัย
- เราปกป้องข้อมูลส่วนบุคคลของท่าน ด้วยระบบการรักษาความมั่นคงปลอดภัยทางเทคนิค และทางบริหารจัดการที่ผ่านการทดสอบและการรับรอง เราให้ความรู้แก่บุคลากรเกี่ยวกับนโยบายและหลักการคุ้มครองข้อมูลส่วนบุคคลของ AST รวมทั้งสร้างความตระหนักในบทบาทและหน้าที่ในการปฏิบัติตามนโยบายและหลักการดังกล่าว
10. การปฏิบัติตามกฎหมายในทุกประเทศ
- เรามุ่งมั่นที่จะปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้องในทุกประเทศที่บริษัท / กิจการในเครือ หรือสาขาของเราดำเนินงานอยู่
11. สิทธิในข้อมูลส่วนบุคคลของท่าน
นอกเหนือจากสิทธิต่าง ๆ ที่ระบุไว้ข้างต้น และเท่าที่กฎหมายไทยที่เกี่ยวข้องกำหนดแล้ว ท่านยังมีสิทธิอันเกี่ยวกับข้อมูลส่วนบุคคลของท่านดังต่อไปนี้
- ท่านมีสิทธิที่จะถอนความยินยอมในการเก็บ ใช้ ประมวลผล และเปิดเผยข้อมูลส่วนบุคคลที่เกี่ยวกับตนเองเมื่อใดก็ได้
- เรามุ่งจัดทำข้อมูลส่วนบุคคลของท่านให้ถูกต้อง และเป็นปัจจุบันอยู่เสมอ โดยจะปรับปรุงและเปิดเผยข้อมูลแก่ท่านเมื่อใดก็ตามที่ท่านร้องขอ ทั้งนี้ ท่านจะเป็นผู้รับผิดชอบในการแจ้งให้เราทราบถึงการเปลี่ยนแปลง แก้ไข หรือเพิ่มเติมใด ๆ ในข้อมูลส่วนบุคคลของตนเอง เพื่อที่ AST จะได้ปรับปรุงข้อมูลให้ถูกต้อง และเป็นปัจจุบันตามที่ได้รับแจ้ง
- มีสิทธิขอเข้าถึง และขอรับสำเนาข้อมูลส่วนบุคคลที่เกี่ยวกับตนได้
- ท่านมีสิทธิขอให้เราเปิดเผยถึงรายละเอียดการได้มาซึ่งข้อมูลส่วนบุคคลที่ตนไม่ได้ให้ความยินยอม
- ท่านมีสิทธิที่จะแก้ไข หรือปรับปรุงข้อมูลส่วนบุคคลของตน หรือขอให้เราดำเนินการปรับปรุงหรือแก้ไข หากข้อมูลส่วนบุคคลดังกล่าวไม่ถูกต้อง หรือไม่เป็นปัจจุบัน
- ท่านมีสิทธิขอรับข้อมูลส่วนบุคคลที่เกี่ยวกับตนจากเราได้ นอกจากนี้ ในกรณีที่เราได้ทำให้ข้อมูลส่วนบุคคลของท่านอยู่ในรูปแบบที่อ่านได้ หรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานอัตโนมัติ และสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ ท่านยังมีสิทธิที่จะ (1) ขอให้เราส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นหากสามารถทำได้ด้วยวิธีการอัตโนมัติ และ (2) ขอรับข้อมูลส่วนบุคคลโดยตรงในรูปแบบที่เราส่งหรือโอนไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่น เว้นแต่จะไม่สามารถทำได้โดยทางเทคนิค
- ท่านมีสิทธิขอให้เราระงับการใช้ข้อมูลส่วนบุคคลที่เกี่ยวกับตน หรือขอให้ลบ หรือทำลาย หรือทำให้ข้อมูลส่วนบุคคลนั้นเป็นข้อมูลที่ไม่อาจระบุตัวตนท่านได้
- ท่านมีสิทธิยื่นคำร้องเรียน ในกรณีที่เรา หรือพนักงาน หรือผู้ให้บริการของเราละเมิด หรือไม่ปฏิบัติตามกฎหมายไทยที่เกี่ยวข้อง
12. การเข้าถึงบริการของเรา
- การเข้าใช้เว็บไซต์ AST มีการควบคุมและจำกัดไว้ให้แก่คนไข้ (สมาชิก?) ที่ลงทะเบียนในระบบ รวมถึงบุคลากรของเราที่เป็นแพทย์ พยาบาล/ผู้ดูแลรายกรณี และผู้เชี่ยวชาญทางการแพทย์เท่านั้น AST ได้ดำเนินมาตรการรักษาความมั่นคงปลอดภัยของข้อมูล ทั้งระบบอัตโนมัติและธรรมดา รวมถึงระบบออนไลน์และออฟไลน์ เพื่อดูแลให้มั่นใจว่าระบบและข้อมูลของเรามีความมั่นคงปลอดภัยอยู่เสมอ เรามีการติดตามประเมิน และพัฒนามาตรการรักษาความปลอดภัยข้อมูลอย่างต่อเนื่อง ตามความจำเป็นและเหมาะสม ทั้งจากกระบวนการทางธุรกิจที่เปลี่ยนแปลงไป จากภัยคุกคามความปลอดภัยข้อมูลใหม่ ๆ หรือเทคโนโลรักษาความปลอดภัยข้อมูลที่ล้ำสมัยขึ้น
